The High Court has ordered the Civil Court to halt the hearings of the case filed by the Maldivian Democratic Party (MDP) against the Police over dismantling the MDP camp set up at the surfers point area. The court has issued a temporary order after the government had questioned the legitimacy of Dr Ibrahim Didi as the legally appointed President of MDP.
The government had taken the factor into perspective at the Civil Court however following the delivery of the final verdict which was not in favour of the government, it had a filed an appeal at the High Court.
The State had pointed out that MDPâ™s basic regulations stipulates that all legal forms must be signed by the President of the party, while Dr Didi had been elected as President of the party in compliance with the new basic regulation of the party which had not been approved by the Elections Commission (EC).
It was noted that the party had only sent the new basic regulation for the ECâ™s approval after Dr Didi was elected President. Citing this point the State pleaded the court to dismiss the case.
However the Civil Courtâ™s final verdict stated that though the Political Party Regulation stipulates that any change brought to a partyâ™s basic regulation should be brought to the attention of and approved by the EC, the regulation does not state that any change brought about is ineffective if uninformed.
A hearing of the case filed by MDP was held today at the Civil Court however, the High Court order was brought to the attention of Judge Hathif Hilmy by the State who declared that hearings have been cancelled until the case concludes or the High Court gives a go ahead to continue the case.
