Male City Council has submitted a case at the Civil Court today over the disputed Usfasgandu area and a second case citing a conflict between the Land Administration Regulation followed by the Housing Ministry and the laws regarding land. The Council has submitted the case to the court while the Police are seeking a court order from the Criminal Court to dismantle the Maldivian Democratic Partyâ™s (MDP) camp at the Usfasgandu area.
Council member Ibrahim Shujau said that two cases had been submitted. One to settle the Usfasgandu dispute, the second to annul the Land Administration Regulation of the Housing Ministry and issue a temporary order to halt the regulationâ™s implementation until a settlement is reached on the Usfasgandu conflict.
âœThe Council submitted two cases. One case is regarding the takeover of the Usfasgandu area by the Housing Ministry and the other case is regarding the conflict between the Land Administration Regulation followed by the Housing Ministry and the Decentralisation Act, Constitution and the Land Act. Thus we have appealed at the court to abolish the regulation,â he said.
The regulation followed by the Housing Ministry had been drafted with the advice from the former Housing Minister Mohamed Aslam.
The Housing Ministry claims that the Usfasgandu area had been leased to MDP in violation of the terms assigned to the council and that leasing public property for political activities for a long period of time would raise conflict and that the ministry had repeatedly requested for the council to correct its mistake.
However the council counters that it had not leased the Usfasgandu area in violation of any regulation and that the area had been leased to MDP under the same policy applied to other political parties under a temporary permit.
