India depute former Indian Judge to assist Enquiry Commission probe

India has assigned a former Indian High Court Chief Justice to assist the National Enquiry Commission established to probe the circumstances surrounding the transfer on February 7 on a request by the Maldivian government, according to Indian Express newspaper. In references to sources in the Ministry of External Affairs the Indian Express reported that former Punjab and Haryana High Court Chief Justice Mukul Mudgal had requested to go to Maldives to help the commission in its investigation.

The newspaper further claimed that Judge Mudgal had been deputed to determine whether controversial transfer of power from the then President Mohamed Nasheed to previous Vice-President and current President Mohamed Waheed Hassan Manik was constitutional or not.

When contacted, Justice Mudgal, who returned to India last week said, “I have given my advice on the transfer of power.... They wanted my help in how to go about holding a transparent inquiry into the entire affair as well as meaning of certain legal terms,” Indian Express reported.

In a bid to comply with the pressures of the Commonwealth, the government had agreed to appoint a retired Singapore Judge as the Co-Chair and a nominee of former President Nasheed to the Enquiry Commission.

Nasheed’s Maldivian Democratic Party (MDP) revealed yesterday that a nomination had been made to the government but stressed that the name of the former President’s nominee to the Enquiry Commission would be disclosed by the Commission itself.
