High Court supports life sentence for mother who gave money for child to buy drugs

High Court Wednesday upheld the ruling of the Criminal Court which sentenced a mother to life in prison for giving money to her child to purchase illegal narcotics. High Court ruled to uphold the Criminal Court’s verdict in 2007 sentencing Majida Mohamed, Maafannu Zillion after finding the woman guilty of giving money to her child studying in grade 9 to purchase narcotics.

The case had been appealed in High Court by Majida herself.

Criminal Court had declared that the testimony of Majida proved beyond reasonable doubt that she had repeatedly given money for her child to purchase narcotics with the knowledge that her child was involved in drug trade.

To that end, Majida had admitted in court that MVR5,000 had been given to her child the first time round to buy drugs.

The High Court’s verdict on Wednesday stated that prior to August 7, 2008 if the testimony of the accused in court varies from the one given during the investigation, then the testimony of the investigating party would be heard by the court.

In addition, once such a testimony is heard and does not refute the testimony of the accused given during the investigation, then the accused would be found guilty on all counts.

The High Court’s verdict further stated that the ruling of the Criminal Court was within the contours of the judicial and constitutional laws as Majida was unable to provide evidence to disprove the testimony given during the investigation.

Henceforth, by the majority of the Judges bench, the ruling of the Criminal Court on the case is upheld, High Court’s verdict said.
