The Anti Corruption Commission (ACC) has said today that it investigates cases in accordance with the set laws and procedures and that the commission has never made false accusations regarding any persons or organizations or spread such false information in the media. The statement came following Malaysian company Nexbis filing a case against the commission claiming that it had acted in violation of the constitution regarding Nexbis’s case pleading the commission be barred from revealing information regarding the lucrative MVR500 million Border Control System (BSC) case which is currently ongoing at the High Court.
The statement issued by the ACC read that the commission had filed a case at court citing corruption in awarding the establishment of the border control system to Nexbis and that “the commission believed they had sufficient proof.â€
The case was sent to the Prosecutor General’s (PG) office on December 7, 2011, on 11 different charges.
It was further stated that the ACC will always remain vigilant in tracking down acts of corruption in projects carried out by state institutions and that the commission will not hesitate to take action if found so.
The case filed by the ACC pleaded that while the case on the Border Control System agreement which was signed on October 17, 2010 is ongoing at court the ACC should be barred from speaking out about the case in various public forums and asked for a public apology from the ACC for tarnishing the company’s reputation through its actions.
It was cited that the ACC has become an obstacle for the company to conduct business in the Maldives and establishing the border control system and that the ACC could also bar Nexbis’ right to a fair trial as stipulated under Article 42 of the constitution.
It also stated that the ACC violated Article 43 of the constitution which entitles Nexbis to fair administrative action and given that Article 141 of the constitution states that no officials performing public functions, or any persons, shall interfere with and influence the functions of the courts, pleaded the court to order the ACC to stop sharing information regarding the case.
