Corruption case of Hinna Khalid has begun at the Criminal Court on Thursday. Hinna, who had been recently appointed as the Under-Secretary of the President's Office, is accused of corruption her tenure as the responsible head of the Male City Council. Prosecutor Generalâ™s Office (PG) attorney Aishath Fazna stated in court during the first hearing of the case held on Thursday that Hinna had tried to gain unfair advantage by bringing the overtime book to Indhira Gandhi Memorial Hospital (IGMH) to sign in it from July 2009 to July 2010, while being admitted in the hospital.
The State attorney announced that the state press charges against her under the Article 23 and 12 of the Prevention and Prohibition of Corruption Act.
After the charges were raised, Hinna denied the allegations and had requested period to appoint herself an attorney. Thursdayâ™s hearing was concluded by Judge Saeed Ibrahim allowing Hinna a ten day period to appoint an attorney.
Article 23 of the Anti-Corruption Act states that a person who attempted to commit an offence stated in this Act shall be culpable in the same manner as a person who committed such an offence. And the same penalty stipulated in this Act for a person who commits an offence mentioned in this Act shall be applied.
Article 12 (a) states that it is an offence for an employee of Government or a Government venture to use position or influence from position, to gain or confer an undue advantage pertaining to a task or connected to a task being carried out by the agency or place of his employment. While (b) states that a person who commits an offence stated in subsection (a) above shall be punishable with imprisonment, banishment or house arrest not exceeding three years.
